Terms of Use

1. Purpose

These Terms of Use (the "Terms") govern the use of the CertiPix service, including the iOS/Android mobile app and the photo-certification API.

CertiPix is a photographic-integrity certification service that lets you prove a photo has not been altered after it was taken.

2. Definitions

• Service: all the features offered by CertiPix (mobile app and API).
• User: any natural or legal person using the Service.
• Certification: the process of generating an integrity certificate for a photo.
• Partner: a company or platform using the CertiPix API.

3. Access to the Service

The CertiPix mobile app is available free of charge on iOS and Android. API access is reserved for Partners holding a valid API key and an active subscription.

4. Description of the Service

CertiPix lets you:

• Certify the integrity of a photo at the moment it is taken.
• Check whether a photo has been altered after certification.
• Timestamp the capture in a verifiable way.

Important: the certificate generated by CertiPix constitutes proof of the image's integrity. It does not in itself constitute legal proof in the strict legal sense and does not replace a judicial expert assessment.

5. Subscriptions

CertiPix offers several monthly plans depending on usage, as presented on the site's homepage:

• Starter (EUR 19/month): 100 certified photos per month, CertiPix badge, online backup and 30 request links of 30 minutes.
• Pro (EUR 39/month): 500 certified photos per month, everything in Starter, 50 links of 30 minutes and 20 links of 1 day.
• Ultra (EUR 99/month): 2,000 certified photos per month, everything in Pro, 500 request links of all types and permanent links.
• Enterprise: custom quote, with volumes, REST API access and infrastructure adapted to the client's needs.

Subscriptions are billed according to the plan subscribed. Unless otherwise stated, unused quotas do not roll over to the next period.

6. User obligations

The User undertakes to:

• Use the Service lawfully and in accordance with these Terms.
• Not attempt to bypass the Service's security mechanisms.
• Not use the Service to certify unlawful content.
• Keep their API key secure and not share it.

7. Liability

CertiPix undertakes to provide a reliable and secure service. However:

• The Service is provided "as is".
• CertiPix does not guarantee 100% availability of the Service.
• CertiPix cannot be held liable for indirect damages related to the use of the Service.
• CertiPix's liability is limited to the amount of the current subscription.

8. Intellectual property

The Service, its source code, its algorithms and its documentation are the exclusive property of CertiPix. The User retains full rights over their photos.

9. Termination

The User may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period. CertiPix reserves the right to suspend or terminate access in the event of a breach of these Terms.

10. Changes to the Terms

CertiPix reserves the right to modify these Terms. Users will be informed of any substantial change. Continued use of the Service after a change constitutes acceptance.

11. Governing law

These Terms are governed by French law. Any dispute shall be submitted to the competent courts of Paris.
